If you do not agree to these Terms, please do not use our website or services. These Terms constitute a legally binding agreement between you ("User", "you") and FlowStrata ("we", "us", "our").

2. Services

FlowStrata provides B2B outbound lead generation services including but not limited to: cold email campaigns, LinkedIn outreach, appointment setting, email deliverability management, and related consulting. Our website also provides free tools (ICP Builder, ROI Calculator, Deliverability Grader, Cold Email Grader) for informational purposes.

Specific service terms, deliverables, pricing, and timelines are governed by a separate Statement of Work (SOW) or Service Agreement executed between FlowStrata and the client. In the event of conflict, the signed Service Agreement takes precedence over these general Terms.

3. Acceptable Use

You agree not to use our website or services to:

  • Violate any applicable laws or regulations, including anti-spam laws (CAN-SPAM, CASL, GDPR)
  • Engage in deceptive, fraudulent, or misleading practices
  • Transmit unsolicited bulk communications in violation of applicable law
  • Attempt to gain unauthorised access to our systems or data
  • Scrape, crawl, or extract data from our website without written permission
  • Infringe the intellectual property rights of FlowStrata or any third party

4. Free Tools, Disclaimer

Our free tools (ICP Builder, ROI Calculator, Deliverability Grader, Cold Email Grader) are provided for informational and educational purposes only. Outputs are estimates based on the inputs provided and industry benchmarks. FlowStrata makes no representations or warranties regarding the accuracy or completeness of tool outputs. Results in your specific situation may differ materially from tool estimates. Tool outputs do not constitute professional advice.

5. Intellectual Property

All content on this website, including text, graphics, logos, tools, templates, and software, is the property of FlowStrata or its licensors and is protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from our content without written permission, except as explicitly permitted (e.g., sharing blog posts with attribution and a link to the original).

Cold email templates provided on this website may be used by you for your own outbound campaigns. They may not be resold, repackaged, or distributed as your own product.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

  • FlowStrata's total liability to you for any claims arising from your use of our website or free tools shall not exceed £100 (one hundred pounds sterling).
  • FlowStrata shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of (or inability to use) our website or free tools.
  • For paid services, liability is governed by the signed Service Agreement. FlowStrata's total liability under any Service Agreement shall not exceed the fees paid by the client in the three months preceding the claim.

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

7. Disclaimer of Warranties

Our website and free tools are provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of viruses or other harmful components.

8. Data Processing

When we provide outbound services on your behalf, we may process personal data of your prospects as a data processor under your instruction. In this capacity:

  • You (the client) are the data controller and are responsible for ensuring you have a lawful basis to contact the prospects we reach out to on your behalf.
  • FlowStrata acts as the data processor and processes prospect data solely for the purpose of delivering the agreed services.
  • A Data Processing Agreement (DPA) is available on request and will be executed prior to any campaign that involves EU/UK resident prospect data.

9. Third-Party Links

Our website contains links to third-party websites and tools. These links are provided for convenience only. FlowStrata has no control over the content or practices of third-party websites and accepts no responsibility for them. Linking to a third party does not imply endorsement.

We reserve the right to modify these Terms at any time. Material changes will be indicated by updating the "Last updated" date. Your continued use of our website after changes constitutes acceptance of the updated Terms. If you object to any changes, your remedy is to stop using our website and services.

11. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of England and Wales, except where mandatory local law requires otherwise.
